Canada to Thailand extradition

A Nigerian man wanted for the murder of a Thai woman has been told he must remain in detention until Canada gets assurances from Thailand he won’t face the death penalty if extradited.

The attorney general of Canada first requested a death penalty assurance in July 2020 and the Thai authorities provided one in September of that year.

Canadian officials were not satisfied by the initial assurance provided by Thailand, however, and more diplomatic talks continued between October 2020 and May 2022, which culminated in a third death penalty assurance from Thailand. The Thai authorities also acknowledged that Memela had already served three years in detention and would receive credit for his time served in Canada.

[Justice] MacNaughton made public that Canada has received a satisfactory death penalty assurance from Thailand in “only one case” and that the extradition process is complicated in the kingdom.

She revealed a different extradition process involving Thailand that lasted roughly a decade, from 2001 to 2011, but was restricted partway through by the military coup in 2006, which added to the existing uncertainties.
What a mess. I would have thought the Thais can do better than this.

Silly Canadians more like. Thailand's laws are just that: Thailand's laws. The crime was perpetrated on a Thai national in Thailand by a non-Canadian who handily skipped out to your land of liberal softiness. Stop telling other countries that have medieval, draconian justice systems what to.

Oh yes, and stop harboring murderers.

Agreed. If Canada's laws permit a non-Canadian accused of murder in a third country to roost at taxpayers expense, all well and good.

I'd guess most Canadians would prefer someone accused of murder in a foreign country (or even within Canada) to be locked up and not out and about in the community. Even if it's at the cost of Canadian taxpayers.

This whole thing about western countries telling other countries what to do is absurd. The U.S. is trying to get that WNBA player released from Russia saying that her detention is political and is purposed to trying to set up a prisoner exchange. Yet everyone seems to be ignoring the fact that she's detained because, and charged with criminal offenses for, having drugs in her possession. Apparently she actually had the drugs, so what's the problem? How do you think that the U.S. or Canada would react to Russia's making demands concerning what's fair or unfair in our criminal justice systems?
