Land Solicitor wanted

Hi,

does anyone have a recommendation for solicitors with the capacity to aquire chanotes for it's clients and assist in the purchase of land?

Any help would be much appreciated.

As chanotes of varying degree will already be in existence for legally owned land, which can easily be transferred upon purchase, I presume you mean getting unregistered land, registered. This is not easy , in fact it may even be illegal as any unregistered land is automatically assumed to be either Royal or government estate .If the former however. I have found the staff at the local land registry office to be very helpful both with advise on ownership and even valuation .

We have land where chanote was so called black chanote. Logo is red and paper did not change when we registered to my wifes name. Black means that chanote has been given with 10 years holding. Selling before that is not possible. It is those plots that government gave to people. We bought land few years before chanote was free and price was a little bit cheaper. To get my wife 's name to chanote took more than 3 years totally. OK, it was easy, when it was possible. Now we are going to split some of it and sell 1-3 rais. Lat 17°22'54.51" Lon 102°51'37.39 in Google Earth. Land will of course be splitted and chanotes made. My advice is to go to land office. They help, because it is their work. :shock:

We have some land for eucalyptus and same, land has been promoted, but not yet officially registered. We have already bought it and after 3 years there will be papers. Full chanote land costs much more than almost chanote.

A piece of land that we are looking in Phen is under the same restriction, was awarded a Chanote with a 10-year hold, 4 years to go from this time. Went to the land office in Phen where they told us that we can not buy this land at this time. We can give money to the owner and receive the restricted Chanote in turn; but that would be considered a loan to the owner against the Chanote, like a mortgage. Our concern is that under that condition, the owner would be able to get the Chanote back by givng us back the money that we would be paying her, a possibility that would be against our interest if the price of the land goes up, and specially if we invest a significacnt amount of money in turning the land into a farm.
It seems to me that we and the seller would be getting around the intent of the law, and that would be risky for some one not well-connected.
Advice, comments, please.

I presume you have a Green coloured Chanote. This is land that was gifted to long term tenants of government land. Knowing the tendency of some to sell anything they can get their hands on, the government decided to make a clause forbidding its sale or use as security for a loan for a 10 year period. Even if the tenant/owner dies during this period it can only be transferred to a direct descendent. It would have no benefit as colateral for a loan as this is strictly forbidden by the terms of the gift .So you would not only be holding a totally worthless piece of paper , to you anyway, you will , if you take possession or build on it be tressspassing. So at any time the owner or his descendents if he were to die , can get you evicted. Bang goes your money and house if you had built on it .Fancy taking a chance? I wouldn't .
All this information , including the date of release is on the Chanote.
