Buying girlfriends ex half of property

Help needed.

I've had a girlfriend in udon for some time, and she is splitting the house with her ex husband ...and she want me too share the house with her, and take care of 50% of the payments, includes pay the ex out from the house with 300k, have any of you guys have any thoughts about this ? please reply I need some advice...best regards ,,,Pella

Get a Lawyer to make sure you are buying out the ex and not just paying off the loan. You have no property rights in Thailand so a userfruct agreement would be essential if you are intending on living in the house yourself. And remember the Golden Rule " never spend money you can't afford to lose "

Is the ex husband Thai or Farang? Either way tread carefully, the golden rule definately applies here.

50% of the payments! Who is paying the other 50%

Forgetting the finances. Are you really thinking of living in the house she shared with her ex? What about the neighbours? All his old buddies , maybe even family,I would assume, living on your doorstep. My advise. Let her sell the house. Pay off the loan. Give him his share, then take your money and any she has left from the sale, and go somewhere else.You can't own it, but it seems a safer proposition to me.

That's a little harsh KB!

I totally agree with Trubrit, living in the house she shared with her ex could be setting yourself up for more problems than you realise and I don't think it is advisable.
I am afraid without knowing more about your circumstances you will find most of the advise perhaps rather cynical.
Do you live here full time? If not, is there any chance the ex will being staying in the house you just paid him for rent free? Happens all the time.
Imagine your sitting home one evening, the ex has spent all his cash and needs some more whisky, who's door is he going to knock on?
Maybe I am tarring all Thai men with the same brush and the gentleman in question is in fact an honourable type but even still you will be surrounded by ghosts of the past.
Talk to your g/f and explain you don't want to live in the house she shared with her ex husband and is there another way.

Plus Rule No.1 " never spend money you can't afford to lose "

I note the OP shows his location as Sweden, which would suggest that he doesn't live with his TW/TGF.

If so, perhaps he only intends to buy out the ex's interest, for his wife/GF to continue living there, and where he may only visit.

In which case unless he has a strong longstanding relationship with her, he maybe taking something of a chance. As suggested previously, I would only consider doing so, if he can afford to lose/write-off that money.

thank you all for your advice....and no the ex have no frieds or family in the area..and he live 60 km from udon now...and i hope i can move to udon in the future..and me and my gf plan to get married soon.but it is scary to buy somthing like this and dount have any papers that say im the owner of this property...i dount know how you guys lives but i whant to have my own house...but maybe its to hard to do that in thailand...thanks again for your interest ...best regards PELLA

As the other posters have said, this needs to be approved legally with your interests at heart , no one else.

Pella,,,,, you should pay careful attention to the forum members here,,,,,, protect yourself with a usafruct through an attorney......... don't look back later and wonder what happened when everything goes "tits up". You will not be able to blame forum members who will probably not be very understanding when you start looking for sympathy...... Good luck.

screw all this lawyer/userfruct/legal advice.

Tell her to take her half and hold it (yeah, I know) until you decide where you'd like to live.

Make YOUR choices independently.

Get her to refinance house for the 300 in her name,you make repayment's on the 300 and if it goes pairshaped just walk away,same as paying rent.

If you do get involved in a property situation with your money,you should get a ''superficies right to use the property from her ,as she will legally own the land and make sure the house is in your name only as you are not yet married!

I believe that a ''usafruct'' is only legal ,if you are married!

it is good for both married and non married, actually better if non married. when i changed name of land/house from ex to Ree, that's what i used. leases in a married relationship are useless, as the wife can cancel the lease one year after divorce. never sign a divorce till all issues are settled.
