Hallo,
Just like to know any of you, if wife died as mine did 2 years ago. And a child of her refuse to sell the land and house to, I’ve agree for a 50 50 split, but she says no.
Legal married and registered, no will of wife, house bought 25 years ago, cost involved of any court case. Heard of any figure? And timescale?
PS. Child change mind a lot, yes to sell, and no sell next day
PS. I still reside in house in UDON THANI CITY

Best to contact lawyer but Roong of squires and Co isn't a lawyer but can walk u through everything and has lawyers she can call on. Been dealing with her more than 15 years and yet to lose a battle

Outside of retaining good legal assistance, I have no other advice for the OP.
An acquaintance of mine had a tortuous relationship with his step-children when his Thai wife was alive. Then she had a serious medical scare that left her in a semi-vegetative state. He carried on living in the house, paying the bills, taking care of her through mostly paying for carers, etc. When his wife finally passed away and after her cremation, he was given 24 hours to vacate the building by her siblings accompanied by local BiB, local thugs and the like. He called their bluff and retained a lawyer but had zero income and the last I heard he was ultimately threatened with death. ie. drive by shootings at night, etc.. By that time he had gone into considerable overstay although he hoped to be able to sell the house to get cash to pay his overstay fine. However, he would probably have gotten a 5-year ban from Immigration so not sure how he got out of the corner he'd helped paint himself into, if he ever did.

hence the need for a good will that is iron clad with all in the extended family understanding the ramifications of the will. Consult a lawyer and have one drawn up in accordance with Thai law... For the original poster, definitely consult a lawyer...

patter, you don't need to waste finances on a lawyer. Without a will or Usufruct on Chanote, you have no rights. At the mercy of the child, and be thankful, you are still allowed to live there, for now anyway.

In the wait for the reply,,,,,,,,,,,,,,, If you have your marriage certificate and her death certificate, I think you can go to the district office and get a copy of the land titles.
Then you can take the children to court for them to either buy your share or sell the property.
It depends greatly on these issues.
1. You are legally married with a certified marriage certificate.
2. You bought the property at the time you were married.
3. Proof that you used your own money or her money that was earned during the marriage and not before the marriage. Someone said………………….

Any small company that does Real Estate, Insurance, Consulting etc has to be watched

You seem to forget where you are at. If I were you, I'd walk away and forget about throwing good money after bad. without a will, I'd wager that you will no doubt get the short end of the stick.

My Thai wife says you should have some right to the estate, go talk to a good lawyer if you can find one but remember Thailand is not like the west or Europe. Good luck.
