The Justice Department’s ‘Troubling’ Discovery Delays

January 6 defendants appear to have practically no shot at a fair trial in Washington, D.C. Some judges are finally pushing back.

It’s been almost seven months since the FBI conducted a pre-dawn raid at the Virginia farm of Thomas and Sharon Caldwell. Dozens of armed agents broke down their front door, ransacked their home, and arrested Tom Caldwell on January 19. A week later, a grand jury indicted Caldwell and two other alleged Oath Keepers for various crimes related to their participation in the Capitol protest on January 6.

Despite the fact Caldwell never entered the building, carried no weapon, and assaulted no one, the Justice Department sought to keep the 66-year-old former Navy lieutenant with service-related disabilities in jail awaiting trial. Caldwell, a decorated military veteran, has no criminal record.

Caldwell was one of more than 100 Americans ensnared in what the top prosecutor managing the first stage of the January 6 investigation called a “shock and awe” campaign to intimidate Americans out of coming to the nation’s capital to protest Joe Biden’s inauguration. But that short-term political goal doesn’t seem to be working as a long-term legal strategy for the Justice Department.

Mehta, who has denied bond to three other Oath Keepers now incarcerated in the D.C. jail for months awaiting trials that won’t begin until 2022, expressed his displeasure with the government this week during a status hearing for Caldwell and 16 other defendants in the Oath Keepers conspiracy case.

Mehta said it was “troubling” to learn that the full trove of discovery material won’t be accessible to defendants until early 2022. That means defendants like Caldwell will have to wait at least a year before all the evidence related to their case will be available to defense attorneys.

Mehta had not heard about the lengthy delay—but as we reported, a prosecutor confirmed that timeline in a separate hearing last month. The government’s full discovery obligations, assistant U.S. attorney Kathryn Fifield told Judge Trevor McFadden in a hearing July 30, would not be met until early 2022 and that was a “conservative” estimate, she said. McFadden replied, “this does not feel what the Constitution [and] the Speedy Trial Act envisions.”

It is all a sham. There are even people identified who created massive damage and incited protesters who were never charged. Probably government agents and informants attempting to set it all up.

Mehta told prosecutors overseeing the Oath Keepers conspiracy case that he wanted an update on the database by August 18 since the first trial date is scheduled for January 2022. The judge also reminded prosecutors about their obligations under the Brady rule, which requires the disclosure of evidence favorable to the defendant.

Chu has made a number of trips to China. Her first trip was in 1990 when relations were only just developing between Beijing and Washington. At the time she was a small-town mayor. She visited China again in 1994 and 1999 as a city councilwoman.

Don’t Ever Believe For One Second That Liberals Give A Damn

They sure talk a good game, don’t they? Be thankful Democrats don’t sell used cars, lest you have a yard full of lemons. No, they sell something worse than junk, they sell lies, and they do it really, really well. But don’t think for a second that they don’t know exactly what they’re doing, and never believe, not even for a moment, that they actually give a damn about what they claim to care deeply about.

They love children. How do I know this? They won’t shut up about them. Not their own kids, yours. Joe Biden doesn’t talk that often about Hunter because he’s a complete screw up junkie with a taste for expensive prostitutes and cocaine is nearly any form. But what you should do to raise your kids is something Joe has very strong opinions on.

“I know there are a lot of people out there trying to turn a public safety measure that is children wearing masks in school so they can be safe into a political dispute,” Biden said this week. “And this isn’t about politics, this is about keeping our children safe.”

Of course, it is all about politics. Biden then goes on to talk about people yelling at some doctors and nurses who advocated for child mask mandates in Tennessee. He went on to say, “These health care workers are heroes. They were the heroes when there was no vaccine…and they’re heroes again with the vaccine.” Yet the Biden administration, and every Democrat, are calling for the firing of those “heroes” who refuse to get vaccinated. Curious way to treat heroes, don’t you think?

Democrats don’t give a damn, either about kids or health care workers. They don’t give a damn about anything.

All the posturing about women’s rights and the cries of “war on women” from the left was always a scam. It took a dozen women and a half dozen months for the left to care about the soon to be resigning pervert Governor of New York history of female exploitation. Politics is so important to the left that one of the leaders of Time’s Up, the Hollywood based appendage of the #MeToo movement, worked to discredit Andrew Cuomo’s accusers. She had to resign because that was akin to booking Harvey Weinstein to present Bill Cosby with the lifetime achievement award at the local rape crisis center. But progressives are progressives first, anything else a distant second.

Leftists don’t view people as individuals, they view them as opportunities. If they’ll advance their agenda, they’ll use them and throw them away the moment the outlive their usefulness.

Remember Cindy Sheehan? It’s likely been a while since you’ve thought of her because her usefulness to the left ended after the 2008 election. But up until that point she was fixture on cable news and the Sunday shows because she was a vocal critic of the George W. Bush administration. She blamed Bush for the death of her son in Iraq, and leftists adopted her as the face of the anti-war movement. They camped her on the road outside Bush’s property in Texas when he was there, and on the set of "Meet the Press" when the President was in DC.

Once Barack Obama won the election, Cindy Sheehan no longer had a purpose and she disappeared. More accurately, she was disappeared by the very media Democrats who’d helped create her.

The other people who helped create her were the anti-war movement, which also disappeared as soon as Obama was elected. Weird, right? They cared so deeply and were a constant presence on television, then poof…they were gone.

The only reason Cuomo had to resign was he was he stopped being useful and became a liability. Ted Kennedy, who had a career of way worse assaults on women, died a hero to the left because he never made the liability transition. Bill Clinton only lost his shine recently, when leftists tried to paint President Donald Trump as, well, what Bill Clinton has always been. Until he became a liability, he was hero. That he participated in a discussion on women in politics with Kamala Harris this year tells you how sincere the denouncing was.

Democrats are frauds; leftists will lose anything and anyone to get their way, nothing is sacred or out of bounds. The “concern” for children they’re expressing now will be exchanged for something else soon enough. Whatever that something else ends up being will be tossed aside once the next useful thing rolls around. Just as Cindy Sheehan, if you can find her.

I didn’t declare war on the establishment; it declared war on me.

It declared war on me when it supported energy policies that could enrich Saudi Arabia and Russia and would cost me more money at the gas pump or on my power bill.

It declared war on me when it told me my ideas weren’t worthy of debate and discussion or that they were even so dangerous they couldn’t be shared publicly.

It declared war on me when it used the police powers of the FBI and CIA to first spy on a presidential candidate and then worked to undermine the administration of that candidate after he was elected.

It declared war on me when it told me my religious beliefs did not deserve the protection of the First Amendment.

It declared war on me when it told me boys could compete against girls in high school sports and that they could shower together afterwards.

It declared war on me when it offered citizenship to illegal aliens and shipped American jobs to China.

It declared war on me when it mocked the usefulness of a wall on the Mexican border and simultaneously put up a razor-wire fence around the Capitol.

It declared war on me when it tried to defund the police so that millions of Americans would be left defenseless against mobs from antifa and Black Lives Matter.

It declared war on me when it said America was never great.

It declared war on me when it told my children they are not good enough because they are white.

It declared war on me when it said that defending the Constitution’s rules on federal elections is sedition.

It declared war on me when it told me that I was a domestic terrorist if I didn’t believe the government’s official pronouncements about elections, about free speech, and about right and wrong.

Let’s just say it plainly: The establishment declared war on me and on all conservative Americans when it decided that leftist orthodoxy was more important than the Constitution.

Don’t believe me? Fine, why should you believe a Trump supporter? You’ve been indoctrinated by the national media, Big Tech oligarchs, the Democratic Party, and academic elites to believe without questioning that people like me can’t be trusted. But you don’t have to take my word for it. Listen instead to John Brennan, the former CIA director under President Obama, who speaks authoritatively for the Deep State:

He said on MSNBC that “the members of the Biden team who have been nominated or have been appointed, are now moving in laser-like fashion to try to uncover as much as they can about what looks very similar to insurgency movements that we've seen overseas, where they germinate in different parts of the country and they gain strength and it brings together an unholy alliance frequently of religious extremists, authoritarians, fascists, bigots, racists, nativists, even libertarians.”

This “guilt by labeling” is the antithesis of fair play or justice. It is a convenient mechanism for the ruling class to herd people into identity clusters so that individual rights can be supplanted by group responsibility. If this reminds you of China’s Cultural Revolution, you are not wrong. The ruling class wants you to conform, confirm and comply. If you step outside the lines, be prepared to be shamed, silenced and ostracized.

A shocking example was provided Wednesday when Douglass Mackey of Delray Beach, Fla., was arrested for creating memes that allegedly misled voters in 2016 to think they could vote by texting instead of by actually going to the polls. This is the equivalent of arresting Sacha Baron Cohen for exposing the gullibility of the rich and famous. The FBI offered no evidence that Mackey actually convinced anyone not to vote, but even if it did, so what? Would you rather live in a country where the FBI is hunting down pranksters — four years after the supposed transgression — or a country where voters are expected to be able to recognize a joke when they see one?

But nothing can be taken for granted any more. The people — and even their representatives and senators — are considered enemies of the state because they hold opinions that don’t meet the standards of Joe Biden or (this is even scarier!) Jake Tapper.

No wonder the people are starting to rise up and rebel against the plutocracy. It’s not “We the Oligarchs” who are the source of power in the Constitution, but “We the People,” yet the ruling establishment has forgotten that. If people like Donald Trump and Douglass Mackey are deemed to be “enemies of the state,” then those who would suppress them and their freedoms must be considered “enemies of the people.”

A house divided against itself cannot long stand, but if there is to be a truce it will not come from submission, but from a recognition that all people are created equal, that they all have certain inalienable rights, and that among those are life, liberty and the pursuit of happiness. Those words were worth fighting for once. Are they worth fighting for today?

I don’t know, but I do know this: If Americans can’t have liberty, we can’t have America either — at least not one that is distinguishable from China. The time has come to make a choice.

The U.S. Supreme Court unanimously ruled that a so-called exception to the Fourth Amendment called “community caretaking” does not permit police officers to enter and search your home without first obtaining a search warrant, even if doing so could be in the public’s interest.

In the case Caniglia v. Strom, Edward Caniglia sued after his home was searched by warrantless police officers in 2015.

During that search, police seized two firearms, which Caniglia recovered only after jumping through numerous bureaucratic hoops.

Caniglia later sued law enforcement, arguing their actions violated his Fourth Amendment right against a warrantless search and seizure.
