That's true but what good does it do if you don't own the land it sits on? Some years back a farang from Udon Thani built a house on his wife's land. The marriage went down the tube. He hired an excavator and tore the house down. That caused a lot of problems and it went back to court. He had saved all the receipts and proved that he had paid for it all. He ended up having to rehire the excavator to clean up the mess and restore the land back to what it was before the house was built. He did prove his point and got his revenge. He considered the cost to clean up the mess as money well spent.

The usufruct appears to be quite resilient. I do not know anyone who has one but base my opinion on the fact that if foreigners who use them in Thailand were still losing the farm when love dies, the forums would be chock-full of bad luck stories similar to the one that @glalt mentioned earlier.

A good lawyer with experience is important but, as is the case with yellow books, one needs to have an Amphur and Land Office that doesn't hate foreigners (or charges less to like them).

I have a usufruct on all our lands. Our land office (Nong Wua So) is a tad strict, meaning they would not accept any changes to our lands unless I had okeyd it.
